Terms of service
This is an English translation of the original Spanish document, provided for convenience. If the two versions differ, the Spanish version prevails.
These terms govern the use of the site, the free diagnostic and the measurement dashboard of Apoda LLC. Using any of the three means accepting them.
What Apoda delivers
Apoda regularly asks several artificial intelligence assistants — today ChatGPT, Claude and Gemini — and records which businesses they name, in what order, in what tone and which sources they cite. From that it delivers measurements and a prioritized action plan.
What Apoda doesn't promise
This is the important part and it comes before anything else:
- Appearing in any model's answers, or in a given position, is not guaranteed. Anyone who guarantees it can't deliver it: nobody controls what a third party's model answers.
- Measurements are observations, not predictions. Models aren't deterministic: the same question can give different answers on the same day. That's why Apoda reports ranges where it can measure them, and never merges the indicators into a single score.
- Coincidence isn't causation. When a report shows that visibility rose after an intervention, it's describing a coincidence in time. Without a control group the change can't be attributed to a specific action, and the reports say so where it applies.
- Model providers change their behavior without notice. Apoda measures what happens; it isn't responsible for what those companies decide.
Dashboard access
Access is per person: each authorized email sees only its own business's measurements. Don't share your access with third parties; if someone else on your team needs to get in, ask and their email will be added.
Apoda may suspend access that is used in a way that puts the service or other clients' data at risk.
The free diagnostic
It's a sample, not a full report: it runs a few queries and is meant to show what this is about. It's limited per domain and per day. It creates no obligation for either party.
Payments
Paid plans are billed monthly in advance, in U.S. dollars. There's no minimum term: you can cancel whenever you want and the service continues until the end of the period already paid for. Periods already started aren't prorated.
Who owns what
The methodology, the measurement engine, the dashboard and the texts on this site belong to Apoda. Your business's data is yours: you can ask for a copy of your measurements at any time, and if you end the service you take it with you.
Apoda doesn't publish a client's results without their written permission. The examples on this site are measurements of our own business, on purpose.
Acceptable use
Reselling the service, automating access to the dashboard, attempting to access other clients' data, or using the free diagnostic in bulk or in an automated way are not allowed.
Limitation of liability
The service is provided as is. Apoda isn't responsible for business decisions made based on its measurements, or for lost profits. In any case, total liability is limited to the amount paid in the three months before the event that gives rise to it.
Termination
Either party can end the service with written notice. On termination, dashboard access is closed; data is kept for the period stated in the privacy policy and deleted sooner if you ask.
Changes
If these terms change, the date at the top changes. Relevant changes are notified by email to whoever is a client at the time.
